TERMS AND CONDITIONS

1. This competition is being conducted by Rupert & Hound Pty Ltd (ABN 30 629 419 343) Seaport Boulevard, Launceston, TAS 7250 (“Promoter”). 

2. Total value of the prize $1,560.00

3. Electronic random drawing system.

4. The promoter is offering the opportunity for people to enter “Win an Exclusive Weekend Away” (Competition).

5. By entering the Competition, the Entrant agrees to abide by these Terms and Conditions. Information regarding prizes and how to enter forms part of these conditions. By entering, the Entrant accepts these Terms and Conditions.

HOW TO ENTER

6. Entry to the Competition is open to Australian citizens and permanent residents (Australian Residents) who are aged 18 years and over as at the time of the Competition and who remain Australian Residents for the duration of the promotional period (Entrant(s)).

7. The Promotion commences at 4.00pm on Thursday 18th April 2019. Entries close on 11.59pm on 27th April 2019. (Promotional Period)

8. Entrants must register their details at www.rupertandhound.com.au during the Promotional Period to be eligible to win the prize.

9. Entrants will only be validly entered if the Entrants provide their:

  • First name.
  • Last name.
  • Valid email address.

10. The Promoter is not responsible for any technical malfunctions or problems with internet or network congestion, including injury or damage to an Entrant or any other person’s computer related to participation in this promotion and problems with transmission of entries over the internet. The Promoter accepts no responsibility for lost, late or misdirected entries.

PRIZE

11. The Promoter offers the opportunity for Entrant to win;

12.One eligible Entrant will win 2 night’s accommodation at One Above Cataract, for four (4) people, including a Tasmanian grazing platter and a selection of Hound Dog Craft Lager and Rupert’s Raspberry Sour.  1 x Gift voucher for two hundred dollars ($200.00) & one (1) bottle of Pirie Vintage Sparkling www.cataractonpaterson.com.au. 1 x Gift voucher for two hundred dollars ($200.00) at Rupert & Hound & four (4) signature cocktails www.rupertandhound.com.au. 

13.Total value is $1,560.00 (Prize Value). The Promoter is neither responsible nor liable for any change in the Prize Value occurring between the publishing date and the date a prize is claimed. The Prize Value is in Australian dollars.

ELIGIBILITY FOR PRIZES

14. For an Entrant to be eligible to win the prize Entrant must:

16.  It is the responsibility of the Entrant to ensure that they have met all eligibility requirements, if any.

CONDITIONS OF PRIZE

17. One (1) draw will be conducted with an eligible Entrant being randomly selected at 2.00pm on 28th April 2019 (Draw Date).

18. The winner of the Exclusive Weekend Away will be announced and published on 28th April 2019 after 2.00pm. 

19. Winner of the prize will be able to organise their weekend away visit between 29th April 2019 to 20th November 2019.  Accommodation is subject to availability.

20. People under 18 at the time of redeeming the prize are not allowed to consume alcohol.

DRAW OF PRIZE

21. The draw will take place at the Promoters address, 30 Seaport Boulevard, Launceston, Tasmania, 7250 on the Draw Date and will be officiated by an external scrutineer.

22. Entrant that win the prize will be notified in writing via their email address. The name of the Prize winner will be published online via Facebook and Instagram on 28th April 2019.

23. Where the Prize winner is under the age of 18, the prize will be awarded to the winner’s nominated parent or legal guardian.

24. If a prize remains unclaimed by a winning Entrant an additional draw will be conducted on the 4th May 2019 of the pool of eligible Entrants to determine the winner of the prize. The draw will be conducted in the same manner as the original draw. Winner of the redraw will be published on 4th May 2019.

ENTRIES AND INTELLECTUAL PROPERTY

25. All claims and entries become the property of the Promoter.

26. An entry, any copyright or other intellectual property rights, subsisting of an entry irrevocably becomes, at time of entry, the property of the Promoter. 

RESPONSIBILITY AND LIABILITY OF THE PROMOTER

27. The Promoter accepts no responsibility for loss, late, stolen or misdirected entries.

28. Unless expressly stated within these Terms and Conditions, or as otherwise provided by the Promoter all expenses are the responsibility of the Entrants.

29. The Promoter is not liable to any Entrant that does not receive an email or cannot access the webpage or submit their details due to technical difficulties or any other reason.

30. The Promoter is not responsible in any manner whatsoever for any problems or any financial costs incurred, or any combination thereof, including any injury or damage to participants or any other persons related to or resulting from participation in this Competition.

31. The Promoter will not be liable for any loss or damage suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained as a result of receiving, taking or using any prizes, except for any liability which cannot be excluded by law. The Promoter’s liability in all cases will be limited to the value of the relevant prizes.

32. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Competition, the website(s), the information on the competition website, or to otherwise undermine the legitimate operation of the Competition may be a violation of criminal and civil laws. Should an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for these losses, damages and costs.

VARIATION AND CANCELATION

33. No responsibility or liability is accepted for any variation to the prizes. In the event that any prize is unavailable, the Promoter reserves the right to substitute a different prize of equal or greater value subject to any written directions from the various state authorities.

34. Subject to the relevant state authority approval, if required, the Promoter reserves the right to modify the terms and conditions of this Competition at any time.

35. Subject to the relevant state authority approval, if required, the Promoter reserves the right to vary the Prize with a prize of equal or greater value.

36. Subject to the relevant state authority approval, if required, the Promoter reserves the right, in its absolute discretion, at any time before the awarding of the prizes to cancel the Competition or to vary or cancel the award of a prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):

  • a. a winner does not satisfy the Competition entry requirements; or
  • b. the Promoter cannot conduct the Competition or award the prizes for any reason beyond its control.

37. Subject to relevant state authority approval, if required, if the Promoter cancels the Competition or varies or withdraws a prize it shall not:

  • a. be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and
  • b. be required to conduct the Competition at any other time. 

PRIVACY STATEMENT

38. The Promoter will collect Entrants’ personal information to conduct the Competition. If the information requested is not provided, the Entrant may not participate in the Competition. By participating in the Competition and opting-in in the manner required at the time of registering, the Entrant consents to their email address being used by the Promoter for future marketing and promotional purposes. The promoter is bound by the Privacy Act 1988M (Cth).
